Flavoured Vape Ban in Canada, Where the Rules Stand in 2026

No, there is no flavoured vape ban in Canada. Not a national one.

That answer catches people out, because Ottawa has been promising one since 2021. Five years on, it still has not happened, and no date has been set for when it will.

What exists instead is a patchwork. Six provinces and territories have gone tobacco-only. Three allow flavours but restrict them to age-restricted speciality shops. The rest follow federal rules, which do not limit flavours at all. Where you live decides what you can buy.

Below is where the federal proposal actually sits today, which provinces restrict what, and one other rule that is further along than the flavour ban and gets almost no attention.

The Federal Restriction is Still a Proposal

Health Canada pre-published its flavour proposal in Canada Gazette, Part I on 19 June 2021, followed by a 75-day comment period.

It has sat there since.

The department’s Forward Regulatory Plan, updated on 16 July 2026, still lists the file as active. Under timing for publication in Canada Gazette, Part II, it says only that the date is to be determined. Five years in, there is no schedule.

Federal Health Minister Marjorie Michel was asked about it by CBC News in May 2026. She would not give a date, and she would not confirm the restriction is definitely coming. She said she is working with her provincial and territorial counterparts and wants agreement first.

So the short version. Proposed, not enacted, no timeline.

What the Proposal Would Actually Do

Most coverage describes it as a flavour ban. The text goes further than that. Health Canada’s own summary lists three measures.

• Flavour promotion would be limited to tobacco, mint or menthol, including any wording or illustration on packaging.
• All sugars and sweeteners would be prohibited, along with most flavouring ingredients, with limited exceptions for tobacco and mint or menthol.
• Standards would be set for sensory attributes, to prevent any sensory perception outside those categories.

That third point matters. A product labelled as tobacco flavour would still have to meet a sensory standard. Reformulating around a flavour list would not be enough.

Which Provinces Restrict Flavours Today

Provinces and territories set their own retail rules on top of federal law. Six have gone tobacco only. Three allow flavours but restrict where they are sold. The rest follow federal rules.

Note on the territories. Northwest Territories and Nunavut both restrict sales to tobacco flavour. Commencement dates for those two are not confirmed from a government source, so they are left blank rather than guessed.

British Columbia is stricter than Ontario and Saskatchewan on one point. Mint and menthol are treated like any other flavour there, so they sit behind the age restriction too.

What You Can Buy in Ontario Right Now

Nothing has changed for Ontario shoppers.

Ontario took the middle route on 1 July 2020. Flavoured products stayed legal, but sales moved to speciality vape stores and licensed cannabis retail stores. Convenience stores and petrol stations are limited to tobacco, mint and menthol. Registered speciality vape stores are not.

That means the full vape juice range, the salt nicotine e-liquids, the disposable vapes and the vape pods are all still available to adults aged 19 and over in Ontario. Ordering for delivery inside the province works through our Ontario store.

If the federal proposal is ever finalised, that changes. Until it is published in Canada Gazette, Part II, it has no effect on what sits on the shelf.

Why the Federal Restriction has Stalled

Two arguments have pulled against each other for five years.

Health Canada’s stated concern is appeal to young people. The department has pointed to the range of desirable flavours as a factor in the rise of youth vaping.

Industry has argued the opposite. In a meeting recorded by Health Canada in July 2024, one manufacturer said that after Quebec’s prohibition, sales of illegal products increased, and that flavours are critical in helping people who smoke to switch. The Canadian Vaping Association has made similar arguments publicly since 2020.

Canadian data published since then complicates that position. A University of Waterloo report from January 2026, drawing on surveys of 42,499 people aged 16 to 19 between 2017 and 2024, found provinces with flavour restrictions had lower youth vaping rates, with no consistent difference in youth smoking rates.

Health Canada has not approved any vaping product under the Food and Drugs Act as a quit smoking aid.

The Other Rule Worth Watching

Flavours get the headlines. A second file is further along, and it affects anyone who buys online.

Health Canada is preparing the Tobacco and Vaping Products Access Regulations, covering age verification for online and distance sales. The Forward Regulatory Plan puts the Canada Gazette, Part I comment period in autumn 2026, running 60 days. The rules would set out what retailers, senders and couriers each have to do to verify age and identity.

There is a reason this one matters. The same Waterloo report found that young people in provinces with full flavour bans were far more likely to buy online than young people in provinces with no restrictions, at 25.8 per cent against 9.3 per cent. Restricting shop shelves appears to move some purchasing to the internet, which is exactly the gap these regulations are aimed at.

A third file is moving on a similar timeline, consolidating tobacco and vaping reporting requirements for manufacturers and importers.

None of these is in force yet. All three are scheduled to reach public comment before any flavour restriction does.
